KEVIN P. WEIMER represents businesses and corporations of all sizes and individuals in a wide spectrum of legal matters, including business and commercial litigation, employment litigation and counseling, insurance coverage, serious personal injury and wrongful death matters, and False Claims Act (whistleblower) litigation. Mr. Weimer's experience includes work on behalf of defendants and plaintiffs in federal and state courts in Georgia and throughout the United States.
In recognition of his professional accomplishments, Mr. Weimer was selected for inclusion in Georgia Rising Stars for 2006, 2007, 2009, 2010 and 2011 (no individuals were selected for inclusion in 2008 Georgia Rising Stars). In addition, Mr. Weimer has been honored as a barrister in the Joseph Henry Lumpkin Inn of Court, a teaching organization composed of highly respected judges and trial lawyers in Atlanta.
Representative cases:
Mr. Weimer secured the dismissal of a case against a 50% shareholder in a small corporation, in a highly contested battle on personal jurisdiction in the U.S. District Court for the Northern District of Georgia. McDonald v. Ricci, No. 1:07-CV-804-TWT, 2007 WL 2001732 (N.D. Ga. July 5, 2007).
With Hank Fellows, Mr. Weimer successfully defended Giuliani Capital Advisors LLC and three of its employees in a civil action brought by SunTrust Capital Markets, Inc., for alleged breaches of fiduciary duties, alleged violations of the Georgia Trade Secrets Act, and alleged violations of the Georgia Computer Systems Protection Act. The case was dismissed.
Mr. Weimer secured the substantive dismissal of a case against a corporation and individual in Fulton County Superior Court where the plaintiff sought more than $500,000 for alleged transmittal of unsolicited facsimiles in violation of the Telephone Consumer Protection Act.
Mr. Weimer and Hank Fellows of the Firm prepared appellate pleadings before the Georgia Court of Appeals resulting in the reversal of a trial court's finding that a large pipeline company partially had abandoned its easement rights in Hart County, Georgia. Plantation Pipeline Co. v. Milford, 572 S.E.2d 67 (Ga. Ct. App. 2002).
In plaintiffs' cases involving serious injury and death, Mr. Weimer has led discovery efforts that resulted in significant settlements on behalf of injured individuals and the families of deceased persons.
Mr. Weimer is very active in several professional organizations. In 2008, he was appointed by the President of the State Bar of Georgia to the committee investigating the implementation of a statewide electronic filing system, and he continues to serve on that committee.
Mr. Weimer also is an active member of the Atlanta Bar Association, where he serves on the Judicial Selection and Tenure Committee and the Board of Directors for the Litigation Section. He also has performed in five "A Courthouse Line" musical parody fundraisers benefiting the Atlanta Bar Foundation's charities. In addition, Mr. Weimer is a member of the Lawyers’ Club of Atlanta.
Mr. Weimer is a past president (2007-2008) of the Atlanta Chapter of the Federal Bar Association. During his tenure as president, the Chapter received three national awards. In 2005, he received the President's Award for Outstanding Service to the Chapter. Mr. Weimer now serves on the national membership committee for the Federal Bar Association.
Mr. Weimer is admitted to practice in state and superior courts in Georgia, in the Georgia Supreme Court and the Georgia Court of Appeals, and before the United States Court of Appeals for the Eleventh Circuit, the United States District Court for the Northern District of Georgia, and the United States District Court for the Middle District of Georgia.
Before joining the Firm, Mr. Weimer received significant trial experience as an intern in the Gwinnett County Solicitor's Office. In that capacity, he first-chaired criminal jury trials and bench trials in Gwinnett County State Court.
Mr. Weimer received his Juris Doctor degree, cum laude, from the University of Georgia School of Law in 2001. He earned his Bachelor of Arts degree in economics and policy studies in 1998 from Rice University, where he was a magna cum laude honor graduate and inducted into Phi Beta Kappa.
During law school, Mr. Weimer demonstrated his trial skills by winning the 1999 J. Melvin England Mock Trial Competition at the University of Georgia, and his team had the best brief and was runner-up at the 2000 Georgetown National White Collar Crime Mock Trial Invitational in Washington, D.C.
As a moot court coach, Mr. Weimer led two teams of UGA law students to first and second place finishes in the 2001 Intrastate Moot Court Competition. As a result of his advocacy activities, he was named to the Order of Barristers in 2001.
Mr. Weimer is married and lives near Decatur, Georgia. He and his wife attend Intown Community Church.
